Legal Developments at National Level
General Data Protection Regulation (GDPR)
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) has formed the basis for general data protection law in European Union Member States – and thus also in Austria – since 25 May 2018. This regulation is directly applicable in Austria, and the Austrian Data Protection Act was amended accordingly. In a large-scale internal project, the companies in the Casinos Austria and Austrian Lotteries Group identified and implemented the applicable GDPR requirements prior to the prescribed date.
Tobacco and Non-Smoker Protection Act (TNRSG)
The general ban on smoking in public places that should have come into force in Austria from 1 May 2018 was amended, thus extending the existing possibility to allow smoking in public places under specific conditions beyond 30 April 2018. In this regard, the Austrian Gaming Act states that gaming license holders shall be subject in their operating areas to the provisions for catering establishments.
